By accessing or using the Physicare.ai platform (web or mobile), you agree to be bound by these Terms of Service ("Terms"). If you do not accept these Terms, do not use our services.
These Terms should be read in conjunction with our Privacy Policy, which describes in detail how we collect, use, retain, and protect your personal information. By using the platform, you acknowledge having read both documents.
Physicare.ai is a Canadian platform that provides intelligent tools to rehabilitation professionals to assist with clinical documentation, treatment planning, and patient monitoring. Patients can also access a mobile application to view their prescribed plans and monitor their progress.
The artificial intelligence tools integrated into the platform generate suggestions intended to support professionals in their practice. These suggestions are exclusively a decision-support aid and do not in any way replace professional clinical judgment.
Registration is required to use the platform. Professionals must subscribe to a paid plan (monthly or annual). Patients can access the platform for free when invited by a professional.
Users are responsible for maintaining the confidentiality of their login credentials and all activity conducted from their account. You must immediately notify us of any unauthorized use of your account at support@physicare.ai.
A free trial period of up to 14 days may be offered to new professional users. Physicare.ai reserves the right to modify the duration of this period. Users will be informed of the applicable trial conditions at the time of registration.
Payments are processed by Stripe. Subscriptions automatically renew at the end of each billing period unless the user cancels before renewal.
Payments are non-refundable, except where required by applicable law.
You agree to use Physicare.ai only for legal and professional purposes. Prohibited uses include, but are not limited to:
All software, algorithms, interfaces, trademarks, documentation, and services constituting the Physicare.ai platform are the exclusive property of Physicare.ai and are protected by Canadian and international intellectual property laws.
Content generated by the platform's artificial intelligence tools (clinical note suggestions, treatment plans, diagnostic suggestions, exercises, etc.) is produced using proprietary technologies owned by Physicare.ai.
Clinical data entered or generated within the professional-patient relationship (observations, diagnoses, treatment plans, follow-up notes) contain personal health information that remains subject to applicable personal information protection laws and the professional obligations of the relevant professional order.
Accordingly:
By using the platform, you grant Physicare.ai a non-exclusive, worldwide, royalty-free license to use data entered on the platform solely for the purpose of providing, maintaining, and improving the services. The use of anonymized data for AI training is subject to separate consent, as described in our Privacy Policy.
Physicare.ai provides AI-generated suggestions to support rehabilitation professionals. However:
To the maximum extent permitted by applicable law, Physicare.ai, its officers, directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages resulting from:
Nothing in these Terms excludes or limits the liability of Physicare.ai where applicable law prohibits such exclusion or limitation.
You agree to indemnify and hold harmless Physicare.ai from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the platform in violation of these Terms or any applicable law.
Physicare.ai reserves the right to modify these Terms. In the event of a substantial modification, we will notify you at least 30 days before the changes take effect by one of the following means:
Continued use of the platform after the modifications take effect constitutes acceptance of the updated Terms. If you do not accept the modifications, you may stop using the platform and request the closure of your account.
These Terms take effect upon the creation of your account and remain in effect as long as you use the platform.
You may terminate your account at any time through your account settings or by contacting support@physicare.ai.
Physicare.ai may suspend or terminate your access to the platform, with or without notice, in the event of a violation of these Terms, fraudulent or abusive use of the platform, or non-payment of subscription fees.
Upon termination, your right to use the platform ends immediately. Provisions relating to intellectual property, limitation of liability, indemnification, and governing law survive termination. The processing of your personal data after termination is governed by our Privacy Policy.
For users residing in Quebec, these Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein. Any dispute shall be submitted to the exclusive jurisdiction of the courts of the judicial district of Montreal (Quebec). The provisions of the Consumer Protection Act (Quebec) and Law 25 apply to the extent they are applicable, and no provision of these Terms shall be interpreted as limiting the rights these laws confer upon you.
For users residing in another province or territory of Canada, these Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, subject to the mandatory provisions of the law of the user's province of residence that cannot be waived by contract. Applicable federal laws, including PIPEDA, apply with respect to the protection of personal information. In the event of a dispute, the parties shall first attempt to resolve it amicably. Failing that, the dispute shall be submitted to the competent courts of the judicial district of Montreal (Quebec), without prejudice to the user's right to submit the dispute to the courts of their province of residence if applicable law permits.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Physicare.ai regarding the use of the platform.
If any provision of these Terms is found to be invalid or unenforceable by a competent court, the remaining provisions shall remain in full force and effect.
Physicare.ai's failure to exercise a right provided for in these Terms does not constitute a waiver of that right.
These Terms were drafted in French. In the event of a translation, the French version shall prevail.
